PIZZA HALL OF FAME 2014 CONTEST
1.1 Consumer Part
To be eligible for the Consumer Part of this contest (the “Contest”), an individual must:
a. Be a legal resident of a province or territory of Canada; and
b. Be of the age of majority in his/her province or territory of residence or older at the time of entry.
1.2 Pizzeria Part
All independent pizzerias which are clients of Saputo and have a place of business in a province or territory of Canada is eligible to the Pizzeria Part of this Contest.
1.3 General rules for both parts
1.3.1 Those ineligible to enter the contest are:
a. employees, representatives and agents of Saputo Dairy Products Canada G.P., including its affiliates, subsidiaries and related corporations; (collectively the “Sponsor”);
b. employees, representatives and agents of the suppliers of Prizes (hereinafter defined) awarded in this Contest;
c. employees, representatives and agents of the Sponsor’s advertising, promotional and media agencies;
d. people involved in the development, production and distribution of materials related to the contest; and
e. the immediate family of all of the aforementioned persons, or persons with whom such persons are domiciled. In these Contest rules “immediate family” means husband, wife, spouse, mother, father, brother, sister, son and daughter, whether or not they reside in the same household.
1.3.2 The Sponsor has the right to require at any time proof of identity and/or eligibility from the Participant (including a Participating Pizzeria) to allow him to enter the Contest. Failure to provide such proof within a reasonable period of time could result in disqualification.
1.3.3 All information supplied to the Sponsor for the purpose of this Contest must be truthful, accurate and complete. The Sponsor reserves the right to disqualify any Participant (including a Participating Pizzeria) should his Entry Form (including a Pizzeria Entry Form) include false, inaccurate or incomplete information.
2. DEADLINES FOR ENTRY
2.1 Contest Period – Consumer Part
The Contest begins on Monday, October 27, 2014 at 9:00 am (MDT) (the “Contest Starting Date”) and closes on Friday, December 5, 2014 at 11:59 pm (MST) (the “Contest Closing Date”). The period between the Contest Starting Date and the Contest Closing Date is the “Contest Period”.
2.2 Registration Period – Pizzeria Part
The registration period for the Pizzeria Part begins on Monday, September 22, 2014 at 9:00 am (MDT) and closes on Friday, October 17, 2014 at 11:59 pm (MDT) (the “Pizzeria Registration Period”).
3. HOW TO ENTER THE CONTEST
3.1 Consumer Part
3.1.1 There is no purchase necessary to enter the Consumer Part of the Contest. To enter the Contest, the participant (the “Participant”) may visit the contest website at www.pizzahalloffame.ca (the “Contest Website”). On the homepage, the Participant will find all necessary information to vote for his/her favourite Participating Pizzeria (hereinafter defined) and then enter the Contest by filling out the entry form (the “Entry Form”) with the following information: full name, year of birth, complete mailing address, daytime telephone number, email address and the language for correspondence. The Participant must also confirm that he has read these Contest rules and declare that he/she agrees to its terms.
3.1.2 The Participant can submit only one (1) Entry Form per day during the Contest Period and only one (1) Entry Form per IP Address per day can be submitted. Every time he/she enters the Contest, the Participant will have an additional chance to win.
3.1.3 Use of any automated system to submit an Entry Form is prohibited and will result in disqualification. The Entry Form shall be submitted by the Participant in his own name and a proxy cannot be given to this effect, failing which the Participant will be disqualified. Entry Forms are not eligible and will be rejected if any information is missing.
3.1.4 In the event of a dispute regarding any Entry Form, the Entry Form will be declared made by the authorized account holder of the email address submitted at the time of the entry (i.e the person who is assigned to an email address by an Internet access provider, on-line service provider or other organization that is responsible for assigning email addresses for the domains associated with the submitted email address).
3.2 Pizzeria Part
3.2.1 There is no purchase necessary to enter the Pizzeria Part of this Contest. To enter the Contest, the pizzeria manager (the “Manager”) has to inform a sales representative of the Sponsor of his/her intention to enter the pizzeria to the Contest.
3.2.2 Then, the Manager will have to fill out the appropriate entry form (the “Pizzeria Entry Form”) given by the Sponsor sales representative and return it to the sales representative during the Pizzeria Registration Period to become a participating Pizzeria (a “Participating Pizzeria”).
3.2.3 A Participating Pizzeria can submit only one (1) Pizzeria Entry Form during the Pizzeria Registration Period.
4. WINNERS SELECTION
4.1 Consumer Part
4.1.1 Grand Prize Winner
a. On January 22, 2015 at 9:00 (MST) at the place of business of the Sponsor located at 16110 – 116 Avenue, Edmonton, Alberta (the “Sponsor’s Business Place”), one (1) Participant will be selected (a “Selected Participant”) by random draw (the “Grand Draw”) among all the eligible Entry Forms received to win the Consumer Grand Prize (a “Selected Participant”).
b. The odds of being selected to win the Consumer Grand Prize are dependent upon the total number of eligible Entry Forms received by the Contest Closing Date.
4.1.2 Secondary Prize Winners
a. On every Thursday, starting November 6, 2014 until December 4, 2014, at noon (EST) at the place of business of Traffik located at 559 College Street, Suite 301, Toronto, Ontario, twenty (20) Participants will be randomly selected (each a “Selected Participant”) (the “Secondary Draws”) (the Grand Draw and the Secondary Draws are together the “Draws” or each a “Draw”) among all the eligible Entry Forms received by each Secondary Draw to win a Consumer Secondary Prize. For purposes of accuracy, non-selected eligible Entry Forms will automatically carry over the next Secondary Draw.
b. The odds of being selected to win the Consumer Secondary Prize are dependent upon the total number of eligible Entry Forms received by each Secondary Draw.
4.1.3 Requirements to be declared Winner
a. Each Selected Participant will be notified by phone or email within five (5) business days of Draw, considering the information mentioned on the Entry Form. In the event a Selected Participant cannot be contacted by phone or email (or fail to respond to messages) within five (5) business days from the time of initial contact, such Selected Participant will be disqualified from the Contest and forfeit the Prize. The Sponsor may then, in its sole and absolute discretion, select another Participant in accordance with paragraphs 4.1.1 or 4.1.2, as the case, or forfeit the Prize. That new Selected Participant is subject to disqualification of he/she does not comply with this paragraph.
b. To be declared winner of a Consumer Prize (each being a “Consumer Winner”), each Selected Participant will be required to execute a declaration and release form he/she shall receive by email (the “Declaration and Release Form”) acknowledging and confirming compliance with these Contest rules as well as the non-responsibility of the Sponsor and any other organization involved with the Prize (hereinafter defined) or the Contest and their respective employees, for any injury, accident, loss or misfortune related to the Contest, the Prize or awarding of the Prize. Each Selected Participant also has to correctly answer the mathematical skill-testing question on the Declaration and Release Form, with no assistance of any kind.
c. In the event that a Selected Participant does not answer correctly the math skill-testing question or if the Declaration and Release Form duly completed and executed by the Prize Winner is not received by the Sponsor before the date indicated on the Declaration and Release Form, the Sponsor may, at its sole discretion, select another Participant within the remaining valid Entry Forms in accordance with the paragraphs 4.1.1 or 4.1.2, as the case, or forfeit completely the attribution of the Prize. That new Selected Participant is subject to disqualification if it does not comply, with this paragraph.
4.2 Pizzeria Part
On January 22, 2015 at 9:00 am (MST) (the “Selection Date”) at the Sponsor’s Business Place, the Participating Pizzeria which obtains the highest rate of votes from the Participants at the Contest Closing Date will be selected to win the Pizzeria Grand Prize (the “Selected Pizzeria) and the Participating Pizzeria that obtain the highest rate of votes from the Participants in each Canadian province at the Contest Closing Date, will be selected to win a Pizzeria Secondary Prize (each a “Selected Pizzeria”). Maximum ten (10) Pizzerias will be selected to win a Pizzeria Secondary Prize, but no Pizzeria Secondary Prize shall be remitted in the province where the Selected Pizzeria to win the Pizzeria Grand Prize is from, nor in Nunavut, Yukon or Northwest Territories. Therefore, there might be only nine (9) Selected Pizzerias to win a Pizzeria Secondary Prize.
4.2.2 Requirements to be declared winner
a. Each Selected Pizzeria will be notified by phone or email in accordance with the contact information provided on its Pizzeria Entry Form within five (5) business days of the Selection Date. In the event a Selected Pizzeria cannot be contacted by phone or email (or fails to respond to messages) within five (5) business days of the initial contact, it will be disqualified from the Contest and forfeit the Prize. The Sponsor may then, in its sole and absolute discretion, select another Participating Pizzeria in accordance with paragraph 4.2.1 or forfeit the Prize. That new Selected Pizzeria is subject to disqualification if it does not comply with this paragraph.
b. To be declared winner of a Prize (a “Pizzeria Winner”) (the Consumer Winners and the Pizzeria Winners being the “Winners”) each Selected Pizzeria will be required to complete and sign a Declaration and Release Form. Each Selected Pizzeria also has to correctly answer to a mathematical skill-testing question on the Declaration and Release Form, with no assistance of any kind.
c. In the event that a Selected Pizzeria does not answer correctly the math skill-testing question or if the Declaration and Release Form duly completed and executed is not received by the Sponsor within the delay indicated on the Declaration and Release Form, the Sponsor may, at its sole discretion, select another Participating Pizzeria within the remaining valid Pizzeria Entry Forms in accordance with paragraph 4.2.1 or forfeit the attribution of the Prize. That new Selected Pizzeria is subject to disqualification if it does not comply with this paragraph.
5. PRIZES DETAILS
5.1 Consumer Part
5.1.1 Grand Prize
a. One grand prize shall be awarded in the Consumer Part of this Contest, consisting of fifty-two (52) vouchers applicable in the Participating Pizzeria the Consumer Winner voted for. The vouchers allow one (1) free pizza a week during fifty-two (52) weeks (the “Consumer Grand Prize”). Each free pizza must have a maximal value of twenty-five dollars in Canadian currency (C$25).
b. The approximate value of the Consumer Grand Prize is one thousand and three hundred dollars in Canadian currency (C$1,300).
5.1.2 Secondary Prizes
a. One hundred (100) secondary prizes shall be awarded in the Consumer Part of this Contest, each consisting of one (1) voucher applicable in the Participating Pizzeria the Consumer Winner voted for (each a “Consumer Secondary Prize”) (the Consumer Grand Prize and the Consumer Secondary Prizes are the “Consumer Prizes”). Each voucher allows one (1) free pizza which must have a maximal value of twenty-five dollars in Canadian currency (C$25).
b. The approximate value of each Consumer Secondary Prize is twenty-five dollars in Canadian currency (C$25).
5.1.3 Awarding of the Prizes
Consumer Prizes will be delivered to the Consumer Winners by Purolator within thirty (30) days of the receipt, by the Sponsor, of the executed Declaration and Release Form.
5.2 Pizzeria Part
5.2.1 Grand Prize.
a. One (1) grand prize shall be awarded in the Pizzeria Part of this Contest, consisting of one (1) year of free supply of Saputo Pizza Mozzarella cheese (the “Pizzeria Grand Prize”). The Pizza Mozzarella cheese will be delivered depending on the orders from the Winner of the Pizzeria Grand Prize over a twelve (12) month period. The total value of the Pizzeria Grand Prize can’t be higher than the value indicated in paragraph b.
b. The approximate value of the Pizzeria Grand Prize is ten thousand dollars in Canadian Currency (C$10,000).
5.2.2 Secondary Prizes.
a. Ten (10) secondary prizes in the Pizzeria Part of this Contest, each consisting of one thousand dollars in Canadian currency (C$1,000) of Saputo Pizza Mozzarella cheese delivered over three (3) month period maximum (each a “Pizzeria Secondary Prize”) (the Pizzeria Grand Prize and the Pizzeria Secondary Prizes are the “Pizzeria Prize”). The number of Pizzeria Secondary Prizes depends of which Canadian province or territory the Finalist for the Winner of the Pizzeria Grand Prize is from, in accordance with sub-section 4.2.2.
b. The approximate value of each Pizzeria Secondary Prize is one (1) thousand dollars in Canadian currency (C$1,000).
5.2.3 Awarding of the prizes
Pizzeria Prizes shall be delivered to the Pizzeria Winners depending on the orders made by the Pizzeria Winners.
6. GENERAL CONDITIONS
6.1 Each Prize (the Consumer Prizes and the Pizzeria Prizes being together the “Prizes”) must be accepted as awarded and may not be substituted or converted to cash. No substitution is possible, except in the Sponsor’s sole and entire discretion. Any portion of a Prize not accepted by the Winner will be forfeited. The Sponsor will not be responsible if any event resulting in the cancellation of a Prize or if other factors beyond its reasonable control prevent a Prize or any part thereof from being fulfilled. The Sponsor makes no express or implied warranties of any kind with respect to safety, appearance or performance of any aspect of a Prize or Prize related activity. By accepting a Prize, the Winner acknowledges that the warranties applicable to any aspect of the Prize, if any, are the warranties provided by the supplier of the Prize to the Sponsor that are transferable and/or the manufacturer’s warranty. In no circumstance whatsoever, the Winner shall have any recourse against the Sponsor with respect to any warranty of a Prize.
6.2 All Entry Forms and Pizzeria Entry Forms become the property of the Sponsor.
6.3 Any attempt to deliberately damage the Contest Website or any related website, or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws. In such cases, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
6.4 Entry Forms and Pizzeria Entry Forms are subject to verification and will be declared invalid if they are received outside the Contest Period or are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with any way.
6.5 No correspondence pertaining to the Contest will be entered into except with the Selected Participants, the Selected Pizzerias and the Winners.
7. INDEMNIFICATION BY PARTICIPANT
By entering the Contest, a Participant (including a Participating Pizzeria):
• releases the Sponsor and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all liability for any injury, loss or damage of any kind to the Participant or any other person, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in this Contest, any breach of these Contest rules, or in any Prize-related activity;
• agrees to fully indemnify the Sponsor and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all claims by third parties relating to the Contest, without limitation.
8.1 By entering this Contest, a Participant (including a Participating Pizzeria) agrees to be bound by these Contest rules, which are posted on the Contest Website throughout the Contest Period.
8.2 It is also possible to obtain a copy of the rules by sending a letter with a pre-addressed and prepaid envelop to the following address : Saputo Dairy Products Canada G.P, to the attention of Marielle Taylor, “Pizza Hall of Fame” contest, 279 Guelph Street, Georgetown, Ontario, L7G 4B3.
8.3 The Sponsor reserves the right, in its sole discretion, to disqualify any Participant (including a Participating Pizzeria) it finds to be :
• violating these Contest rules;
• tampering or attempting to tamper with the entry process or the operation of the Contest Website, or any related website;
• acting in an unsportsmanlike unfairly or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
9. LIMITATION OF LIABILITY
9.1 The Sponsor assumes no responsibility or liability for lost, delayed, destroyed or misdirected Entry Forms or Pizzeria Entry Forms, notice, notifications, responses, emails, Declaration and Release Forms or for any computer, software, telephone, online connection or any other technical malfunctions that may occur.
9.2 The Sponsor is not responsible for any incorrect or inaccurate information, whether caused by users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest.
9.3 The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (the « Régie »), to cancel, suspend or modify the Contest, should a virus, bug, computer problem, unauthorized human intervention or other cause beyond the Sponsor’s control, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest.
10. RELEASE/PRIVACY/USE OF PARTICIPANT INFORMATION
10.1 By entering this Contest, Participant (including a Participating Pizzeria) agrees to the use of its personal information provided to the Sponsor for the purposes of administering the Contest and awarding of the Prize and acknowledges that the Participant’s personal information will not be provided to any third parties, other than as provided for in these Contest rules.
10.2 By accepting the Prize, the Winner grants permission to the Sponsor to use his name, address (city, province), photograph, likeness, voice, image and Prize information for promotional purposes without further compensation unless prohibited by law.
11. INTELLECTUAL PROPERTY
All intellectual property and all of the promotional materials, web pages and source code are owned by the Sponsor and/or its affiliates. All rights are reserved. Copying or unauthorized use of any copyrighted material or trade-mark without the express written consent of its owner is strictly prohibited. SAPUTO is a registered trademark owned by Saputo Dairy Products Canada G.P.
These are official Contest rules. This Contest is subjected to federal, provincial and municipal laws and regulations. These Contest rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor.
13. RESIDENTS OF QUEBEC
Any dispute respecting the conduct or organization of the Contest may be submitted to the Régie for a ruling. Any dispute respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
Within thirty (30) days of each Draw and of the Selection Date, the Sponsor will post the name of the Winners on the Contest Website for a period of at least thirty (30) days.
